1. Scope

These Terms and Conditions (T&Cs) apply to all contracts concluded via the online shop soira-official.com between Sarah Hanisch and Yvonne Hartung GbR (hereinafter referred to as "Provider") and its customers. The online shop is addressed to both consumers and businesses.

3. Offer and Conclusion of Contract

  1. The display of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

  2. Customers can place products in the shopping cart without obligation and complete the ordering process by clicking the "Buy Now" button.

  3. The purchase contract is concluded when the customer receives the order confirmation by email.

  4. By submitting the order, the customer agrees to these T&Cs. An active acceptance via a checkbox in the checkout is required.

  5. Commercial resale of our products is prohibited.

4. Prices and Payment Terms

  1. All prices in the online shop include statutory VAT.

5. Delivery Terms

  1. Delivery is made via DHL and Hermes with tracking. Please check on our Shipping Page the Zones of Delivery.

  2. Shipping costs within Germany are waived for orders above a certain amount (see website). For lower amounts, the customer bears the shipping costs displayed during checkout.

  3. Delivery usually takes 2–4 business days after payment is received. Please check on our Shipping Page the delivery time for the chosen Zones of Delivery.

  4. Digital products, if offered, will be provided in digital form.

6. Right of Withdrawal

  1. Consumers have a 14-day right of withdrawal.

  2. The withdrawal must be declared in writing via email to soira.contact@gmail.com.

  3. To exercise the right of withdrawal, products must be unused, in the original packaging, and with intact labels.

  4. Excluded from the right of withdrawal are personalized products, earrings for hygiene reasons, and digital products unless otherwise agreed.

  5. Customers may choose to exchange the product for another instead of returning it.

7. Warranty and Liability

  1. Statutory warranty rights apply. For consumers, the warranty period is 24 months from delivery; for businesses, 12 months.

  2. The provider is liable only for damages caused by intent or gross negligence. Liability for lost profits is excluded.

  3. In case of slight negligence, the provider is only liable for breaches of essential contractual obligations (cardinal duties).

8. Contract Language and Jurisdiction

  1. The contract may be concluded in German or English.

  2. The place of jurisdiction for all disputes arising from contractual relationships with merchants, public law entities, or special public funds is Berlin, Germany.

9. Data Protection

  1. Customer data is used exclusively for order processing and improving customer relationships.

  2. Personal data will not be shared with third parties without explicit consent.

  3. Customers are informed about the use of analytics tools and data collection via the cookie notice.

10. Final Provisions

  1. German law applies, excluding the UN Sales Convention.

  2. Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
